TRAFFIC ACT—REGULATION
(Relating to the imposition of restrictions on the standing, waiting or parking
of vehicles on certain public streets and to the issue of penalty notices)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 19th April, 1991.
Amendment
2. The Motor Traffic Regulations 1935 are amended:
| (a) | by inserting in appropriate alphabetical order in Regulation 2 (1) the following definitions: |
“Public Utility Service Vehicle” means a vehicle being used by a public authority or statutory body in connection with the supply of water, gas, electricity or the like or to remove garbage;
“Restricted Parking Area” means a group of public streets (or parts of public streets) defined by signs erected or displayed adjacent to the area entrances;
| (b) | by inserting in the definition “Parking Bay” after the words “shared traffic zone” whenever appearing the words “or restricted parking area”; |

(c) by inserting after Regulation 54 (6) (an) the following paragraph:
(ao) the words “restricted parking area” appearing on a traffic
control sign (in or similar to the form of the sign illustrated
in Diagram 52 in the Schedule to this Regulation) mean,
and the direction represented by the traffic control sign on
which they appear is, that the driver of a vehicle (other
than a public utility service vehicle) who approaches that
sign from the direction in which it is facing, must not,
except when actually engaged in taking up or setting down
persons or goods, between that sign and any traffic control
sign facing the driver on which appear the words “end
restricted parking area” (being a traffic control sign in or
similar to the form of the sign illustrated in Diagram 53 in
the Schedule to this Regulation) cause a vehicle to stand or
wait or to be parked otherwise than in a parking station or
in accordance with the directions marked on a parking bay
in the area between the signs.
| (d) | by inserting in the Schedule to Regulation 54 after Diagram 51 the following Diagrams: |

a person who is subject to the control and direction of the Darling Harbour Authority as an enforcement officer for the purposes of this Regulation is a prescribed officer in respect of an offence against Regulation 54 (6) (ao).

EXPLANATORY NOTE
The object of this Regulation is to amend the Motor Traffic Regulations 1935:
(a) to prohibit the standing, waiting or parking of a vehicle within a restricted parking area contrary to a direction on a traffic control sign erected at or near the entrance to such an area; and (b) to provide that actions contravening that prohibition may be dealt with under the penalty notice system by certain officers subject to the control and direction of the Darling Harbour Authority. (The penalty notice system set out in the Traffic Act 1909 allows service on a person alleged to have committed a specified offence of a notice to the effect that the matter need not be determined by a Court, but may be finally determined by payment of the penalty specified for the offence.)
