TRAFFIC ACT 1909—REGULATION

(Relating to the extension of pensioner concessions to war widows)

HIS Excellency the Governor. with the advice of the Executive Council. and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

The Motor Traffic Regulations 1935 are amended by inserting at the end of Regulation 5 (1) (b) the following word and paragraph:

; or

(b1) who is a woman who is the holder of a Dependant Treatment Entitlement Card issued on behalf of the Commonwealth Department of Veterans' Affairs and:

(i) in the case of a woman who is of or above the age of 60 years—who is entitled to receive an age pension under the Social Security Act 1947 of the Commonwealth at the maximum rate applicable under section 41 of that Act: or

(ii) in the case of a woman who is under the age of 60 years— who would be entitled (if she were, in fact, of or above the age of 60 years) so to receive an age pension at that maximum rate.

EXPLANATORY NOTE

The object of this regulation is to extend pensioner status, for the purposes of the Motor Traffic Regulations 1935, to any war widow who holds a Dependant Treatment Entitlement Card and whose income is not greater than the amount above which an age pensioner ceases to ne entitled to an age pension at the maximum rate. As a consequence, such a war widow is entitled to an exemption from motor vehicle registration fees and driver's licence fees.
