TRAFFIC ACT 1909 - REGULATION

(Relating to the driving of coaches and heavy

motor vehicles)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 23 February 1990.

Amendments

2. The Motor Traffic Regulations 1935 are amended:

(a)

by omitting Regulation 124 (1) and (2) and by inserting instead the following clauses:

(1) A person must not drive on a public street at a speed in

excess of 100 km/h:

(a)

a motor vehicle that has a manufacturer’s gross vehicle mass (being the maximum laden mass at which the manufacturer recommends the vehicle be operated) that exceeds 4.5 tonnes but does not exceed 13.9 tonnes; or

(b)

a motor vehicle and trailer combination that has a manufacturer’s gross combination mass (being the maximum laden mass at which the manufacturer

recommends the combination be operated) that exceeds

4.5 tonnes but does not exceed 13.9 tonnes; or

(c) a coach or heavy motor vehicle displaying a sign in a form and position approved under Regulation 124A by the Authority.

(2) Despite clause (1), a person must not drive a coach or heavy motor vehicle on a public street at a speed in excess of 90 km/h, unless:

(a) the speed at which the coach or vehicle is capable of travelling is limited, in a manner approved by the Authority by an order published in the Gazette, to not more than the maximum speed approved by the Authority by such an order as reasonable if that manner is used; and
(b) the coach or vehicle is being driven on a length of public street declared by an order of the Authority published in the Gazette to be a designated sector for the purposes of this Regulation; and
(c) signs are displayed on the coach or vehicle in a form and in positions approved under Regulation 124A by the

Authority.

(b) by inserting after Regulation 124 the following Regulation:

S peed-limited vehicles signs

124A. (1) The Authority may, by an order published in the Gazette, approve the form of signs to be displayed on motor vehicles the speeds of which have been limited and approve the positions at which any such sign may be displayed on any such vehicle.
(2) A person must not display on a coach or heavy motor vehicle a sign indicating that its speed is limited or drive a coach or heavy motor vehicle on a public street displaying such a sign unless:

(a)

the speed at which the coach or vehicle is capable of travelling is limited in a manner approved by the Authority; and

(b)

the sign is in a form approved, and in a position approved, by the Authority.

(c) by inserting after the matter relating to Regulation 124 in Table

B of Part 2 of Schedule K the following matter:

EXPLANATORY NOTE

The object of this Regulation is to amend the Motor Traffic Regulations 1935 so as to raise the speed limit of 90 km/h presently imposed on all coaches and heavy motor vehicles to 100 km/h if:

(a) the speed at which the vehicle is capable of travelling is limited in a manner and to the extent approved by the Roads and Traffic Authority and
(b) the vehicle is being driven on a specially designated portion of road; and
(c) the vehicle is displaying signs that state that the speed of the vehicle is limited in the approved manner.

The Regulation also makes it an offence to display a sign on a coach or heavy motor vehicle indicating that its speed is limited, unless the manner in which the speed is limited has been approved by the Authority and the sign is in a form, and in a position, approved by the Authority.
