TRAFFIC ACT 1909 - REGULATION

(Relating to the compulsory wearing of protective

helmets by riders of power-assisted pedal cycles)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

Comencement

1. This Regulation commences on 1 January 1991.

Amendments

2. The Motor Traffic Regulations 1935 are amended:

(a) by omitting clause 110E (2) (c).

(b) by inserting after clause 110E (2) the following clause:

(2A) Clauses (1) and (1A) do not apply before 1 July 1991

to any person:

(a) who was less than 16 years of age on 1 January 1991;
and

(b)

who is travelling on a pedal cycle to which is attached one or more auxillary propulsion motors having a combined maximum power output not exceeding 200 watts.

EXPLANATORY NOTE

At present, the Motor Traffic Regulations 1935 provide, in respect of a person travelling on a pedal cycle with a propulsion motor or motors the total maximum power output of which does not exceed 200 watts, an exemption from the requirement that the person wear a protective helmet.

The object of this Regulation is to amend those Regulations so as to remove that exemption. Persons aged less than 16 years on 1 January 1991, however, retain the benefit of the exemption until 1 July 1991.
