TRAFFIC ACT 1909—REGULATION

(Relating to signs and lights for school buses)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 1 February 1994.

Amendments

2. The Motor Traffic Regulations 1935 are amended:

(a) by inserting after Regulation 130A (1) (b) the following clause:
(b1) a person employed in the Department of Transport as an
enforcement officer for the purposes of this Regulation is a

prescribed officer in respect of an offence against

Regulation 136A;

(b) by inserting after Regulation 136 (6) the following clause:

(7) This Regulation does not apply to a vehicle that is operated

in accordance with Regulation 136A.

(c) by inserting after Regulation 136 the following Regulation:

Warning signs and lights for school buses

136A. (1) In this Regulation:
“warning system” means a system of signs and flashing

lights which is designed to warn motorists of the presence of children on a bus and which complies with the requirements

of the technical specification approved by the Authority for
the purposes of this Regulation;

(2) The owner of a bus must not permit any person to drive the bus for school purposes on a public street unless a warning system is attached to the bus.

(3) A person must not drive a bus for school purposes on a public street unless a warning system is attached to the bus.

(4) The driver of a bus being used for school purposes on a public street must activate the flashing lights of a warning system when stopping the bus to set down or take up children.

(5) The driver of a bus must not, on a public street, activate the flashing lights of a warning system when the bus is not being used for school purposes.

(6) This Regulation does not apply to a bus that is operating on charter for a school excursion.

(7) This Regulation does not apply:

(a)

to the owner of a buswhom the Authority exempts from compliance with this Regulation; and

(b) to a driver of that bus.

(8) The Authority is to make any approved technical

specification available on request.

(9) In this Regulation, a reference to the driving of a bus for school purposes is a reference to the driving of a bus which is being used solely or principally for the conveyance of children to or from school.

EXPLANATORY NOTE

The object of this Regulation is to create offences relating to signs and lights to

be fitted to school buses so as to alert motorists to the presence of children.

The Regulation also empowers certain officers of the Department of Transport to issue traffic infringement notices for breaches of the Regulation by the owner of the bus or the driver, or both, and prescribes penalties for such breaches.

This Regulation is made under the Traffic Act 1909, in particular sections 3 (1)

(a) and (c). 3 (7 ) and 18B.
