TRAFFIC ACT 1909—REGULATION

(Relating to road testing of unregistered motor vehicles)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

The Motor Traffic Regulations 1935 are amended:

(a)

by omitting from Regulation 34 (1) (1) the word “and” where lastly occurring;

(b)

by inserting at the end of Regulation 34 (1) (1) the following word and paragraph:

(m)

section 6 (1) (c) (v) of the Act in respect of any motor vehicle the registration of which has expired but to which the number-plates are still affixed, while the vehicle is being driven by an authorised examiner (within the meaning of Regulation 92A (1)) to determine whether the vehicle complies with the provisions of Schedule F.

EXPLANATORY NOTE

The object of this Regulation is to exempt motor vehicles from the requirement to be registered while being road tested by authorised examiners. The effect of the Regulation will be that section 8 of the Motor Accidents Traffic 1988 will not apply to authorised examiners driving an uninsured motor vehicle.

This Regulation is made under the Traffic Act 1909, including section 3 (1) (11).
