TRAFFIC ACT 1909—REGULATION

(Relating to rest period requirements when driving heavy motor vehicles)

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the Traffic Act 1909, has been pleased to make the

Regulation set forth hereunder.

The Motor Traffic Regulations 1935 are amended by inserting after

Regulation 126A (5) the following subclause:

(6) This Regulation does not apply to the driving of a vehicle by a person when participating in a trial fatigue management program approved by the Authority, so long as the person complies with any conditions imposed by the Authority on participants in the program.

EXPLANATORY NOTE

The object of this Regulation is to exempt persons driving heavy motor vehicles from the rest period requirements contained in the Motor Traffic Regulations 1935 while the drivers are participating in a trial fatigue management program approved by the Roads and Traffic Authority. The exemption will apply only if the driver is complying with any conditions imposed by the Authority on participants in the program.

This Regulation is made under section 3 of the Traffic Act 1909 (the general regulation making power), in particular section 3 (1) (t1) (regulation of driving of heavy motor vehicles) and section 3 (1) (u) (exemptions from regulations).
