TRAFFIC ACT 1909—REGULATION
(Relating to penalty notices for clearway or transit lane offences)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased, to make the Regulation set forth hereunder.

The Motor Traffic Regulations 1935 are amended by inserting before
Regulation 130A (1) (d) the following paragraph:
(c3) a person employed by the Authority as an enforcement officer for the purposes of this Regulation is a prescribed officer in respect of an offence against Regulation 54 (7) by virtue of a failure to comply with a traffic control sign referred to in Regulation 54 (6) (p) (clearways) or (aa) (transit lanes).
EXPLANATORY NOTE
The object of this Regulation is to enable authorised officers of the Roads and Traffic Authority to issue penalty notices against persons who break the law by stopping or waiting on clearways and transit lanes. The Regulation does this by adding those offences to the list of prescribed offences and prescribed officers in Regulation 130A (1) of the Motor Traffic Regulations 1935.
The Regulation is made under sections 3 (the comprehensive regulation-making power) and 18B (penalty notices for certain offences) of the Traffic Act 1909.
