TRAFFIC ACT 1909—REGULATION
(Relating to penalty notice offences and prescribed fees)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1st September, 1992.
Amendments
2. The Motor Traffic Regulations 1935 are amended:
(a) by omitting from Regulation 130A (1) (a) the words “the Secretary of the Police Department” and by inserting instead the words “persons employed in the Infringement Processing Bureau of the Police Service who are authorised by that Commissioner for the purposes of this Regulation”; (b) by omitting from Regulation 130A (1) (f) the word “and” where lastly occurring; (c) by inserting after Regulation 130A (1) (f) the following paragraph: (f1) an employee of a council of a local government area (being a council authorised in writing by the Commissioner of Police for the purposes of this Regulation) who is an authorised officer, within the meaning of section 8G of the Environmental Offences and Penalties Act 1989, in respect of an offence arising under section 8F of that Act is a prescribed officer in respect of:

• any parking offence (as defined in section 18A (5) of the Traffic Act 1909) set out in Table B of Part 2 of Schedule K that is not an offence referred to in paragraph (f); and • any offence under Ordinance No. 34A made under the Local Government Act 1919; and
| (d) | by inserting in paragraph (a) (vi) of item 11 in Schedule A after the word “item” the words “or a tow truck”. |
EXPLANATORY NOTE
The objects of this Regulation are:
| (a) | to authorise certain members of the Police Service to issue penalty notices |
| for any offence that may be dealt with under the Traffic Act 1909 as a penalty notice offence; and | |
| (b) | to authorise officers employed by local councils to participate in |
enforcement of parking restrictions; and
(c) to prescribe the fee for an authorised inspection of a tow truck.
