TRAFFIC ACT 1909—REGULATION
(Relating to parking by authorised residents in metered and pay parking spaces)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 17 March 1995.
Amendments
2. The Motor Traffic Regulations 1935 are amended:
(a) by omitting the heading to Division 1 of Part 5A and by inserting instead the following heading:
Division 1—Preliminary
(b) by inserting in Regulation 91C in alphabetical order the following definitions: “resident parking space” means a metered space or pay parking space that a council has designated under Regulation 91CA for use by holders of resident’s vehicle permits;
“resident’s vehicle permit’’ means an authority given by a
council under Regulation 91CA;
(c)
by inserting after Regulation 91C the following Regulation: Resident’s vehicle permits
91CA. (1) A council may issue a permit authorising the holder
to park a motor vehicle without charge or time restrictions in a
metered space or a pay parking space:

(a)
located within the street, zone or area specified in the permit; and
(b)
designated by the council for use by holders of resident’s vehicle permits.
(2) A resident’s vehicle permit must specify:
(a) the street, zone or area to which it applies; and
(b) the registration number of the motor vehicle to which it relates. (3) For the purposes of this Regulation, a metered space or a pay parking space is designated for use by holders of resident’s vehicle permits if the words “AUTHORISED RESIDENTS VEHICLES EXCEPTED” are displayed on, or next to, the traffic control sign that designates the space to be a metered space or pay parking space.
(d) by inserting after Regulation 91H (9) (b) the following paragraph:
; and
(c)
does not apply to a motor vehicle displaying a current resident’s vehicle permit while it is parked in any resident parking space that is located in a street, zone or area specified in the permit.
(e) by inserting after Regulation 91R (8) (b) the following paragraph:

(c)
does not apply to a motor vehicle displaying a current resident’s vehicle permit while it is parked in any resident parking space that is located in a street, zone or area specified in the permit.
(f)
by inserting after Regulation 91BB (9) (b) the following paragraph:

(c)
does not apply to a motor vehicle displaying a current resident’s vehicle permit while it is parked in any resident parking space that is located in a street, zone or area specified in the permit.

EXPLANATORY NOTE
The object of this Regulation is to permit vehicles displaying a valid resident's
vehicle permit issued by a council to park, free of charge and without time restrictions,
| in metered spaces or other pay parking spaces designated by the council for that purpose. |
This Regulation is made under the Traffic Act 1909, including section 10VE.
