TRAFFIC ACT 1909—REGULATION
(Relating to motor cycle licences and the carriage of pillion passengers by
holders of motor cycle learner’s licences)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1 July 1994.
Amendments
2. The Motor Traffic Regulations 1935 are amended:
(a)
by inserting in Regulation 9 (l), after the words “3 months” in paragraph (b) of the matter relating to Class R licences, the words “(or such lesser period as the Authority may determine in respect of applicants who are over 30 years of age, have demonstrated to the Authority riding competence and who hold, or are eligible to hold, gold licences as described in Regulation 9A ( l))”;
(b)
by omitting Regulation 12 (5) (a) and by inserting instead the following clause:
(a)
if the motor cycle is being used for the carriage of any person except the learner; and

EXPLANATORY NOTE
The objects of this Regulation are:
| (a) | to provide for the issue of an unrestricted motor cycle rider’s licence to mature persons who have successfully completed the Authority’s motor cycle rider training course (if applicable) and who already hold an unrestricted driver’s licence, but who have not held a learner rider’s licence for 3 months or more (item (a)); and |
| (b) | to prohibit the holder of a motor cycle learner’s licence from carrying a pillion passenger when riding a motor cycle (item (b)). |
This Regulation i s made under the Traffic Act 1909, including section 3 (1) (a),
(ml) and (3) .
