TRAFFIC ACT 1909—REGULATION
(Relating to fees for the inspection and registration of hire cars)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 16 December 1994.
Amendment
2. The Motor Traffic Regulations 1935 are amended:
(a)
by omitting Regulation 94 (4) and by inserting instead the following clause:
(4) Clause (3) does not apply to a mourning coach, private hire
car or wedding car.
(b) by omitting item 6 (b) (iv) from Schedule A and by inserting instead the following subparagraph: (iv) in the case of any other public passenger vehicle (not being a mourning coach, private hire car or
wedding car) ................................................... 122
(c) by omitting item 11 (a) (vi) from Schedule A and by inserting instead the following subparagraph: (vi) a taxi-cab or other public passenger vehicle (not being a public passenger vehicle referred to in subparagraph (ii) or (v) or a mourning coach, private hire car or

EXPLANATORY NOTE
The object of this Regulation is to alter the fee regime for the registration, and certain inspections, of private hire cars. The fee for the registration of a hire car (presently $122) will fall into line with that paid for the registration of most other light vehicles (presently $36): amendment paragraph (b).
Likewise, if an inspection is required at the same time as registration, the fee for the inspection will be different (at current rates, $20 instead of $43): amendment paragraph (c). (At the same time, wedding cars and cars that carry mourners at funerals will be put into the same light vehicle category as private hire cars for that fee.)
No fee will be payable for a roadworthiness inspection carried out on a private hire car at the request (at any time) of the Roads and Traffic Authority or the Police: amendment paragraph (a).
This Regulation is made under section 3 (and in particular section 3 (1) (g1), (m) and (s)) of the Traffic Act 1909.
