TRAFFIC ACT 1909—REGULATION
(Relating to fees and charges)

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the Traffic Act 1909, has been pleased to make the
Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1st July, 1993
Amendments
2. The Motor Traffic Regulations 1935 are amended:
| (a) | by inserting in Regulation 2 (1) in alphabetical order the following definition: |
“Tow Truck Operator” has the same meaning as it has in the
Tow Truck Act 1989.
(b) by inserting after Regulation 2 (2) the following clause:
(2A) In these Regulations, a reference to a tow truck is a reference to a tow truck operated or proposed to be operated by a tow truck operator.
| (c) | by omitting from Regulation 17 (5) (a) the matter “16” and by inserting instead the matter “17”; |
| (d) | by omitting from Regulation 17 (5) (b) the matter “15” and by inserting instead the matter “16”; |

by omitting from Regulation 17 (5) (c) the matter “14” and by inserting instead the matter “15”;
(f)
by omitting from Regulation 17 (5) (d) the matter “13” and by inserting instead the matter “14”;
(g)
by omitting Regulation 94 (3) (a) and by inserting instead the following paragraphs:
(a) an articulated motor lorry;
(a1) a motor lorry (not being an articulated motor lorry), including a tow truck that is not a trailer, with an unladen weight of 5 tonnes or more;
(h)
by omitting Regulation 94 (3) (b1) and by inserting instead the following paragraphs:
(b1) a tow truck that is not a trailer with an unladen weight of
less than 5 tonnes;
(b2) a motor lorry (not being an articulated motor lorry or a tow truck) with an unladen weight of more than 2 tonnes but less than 5 tonnes;
(i) by omitting Regulation 94 (3) (c) and by inserting instead the following paragraphs:
(c)
a trailer, including a trailer that is a tow truck, with an unladen weight of 2.5 tonnes or more;
(c1) a trailer, that is a tow truck, with an unladen weight of less

EXPLANATORY NOTE
This Regulation increases fees payable in connection with the administration of
the Traffic Act 1909. in line with the general movement in prices.
The Regulation also corrects references to certain fees and makes clear the fees and charges that are payable in respect of tow trucks (including trailers) that are operated or proposed to be operated by the holder of a tow truck operators licence granted under the Tow Truck Act 1989:
(a) for the registration or renewal of the registration of the vehicle: and
(b) for the inspection of the vehicle by police officers or authorised officers.
The Regulation is made under the Traffic Act 1909, including section 3 (the
general regulation making power).
