TRAFFIC ACT 1909—REGULATION

(Relating to fees and charges)

HIS Excellency the Governor, with the advice of the Executive Council,

and in pursuance of the Traffic Act 1909, has been pleased to make the

Regulation set forth hereunder.

Commencement

1. This Regulation commences on 1 July 1992.

Amendments

2. The Motor Traffic Regulations 1935 are amended:

(a)

by omitting from Regulation 5C the words “by multiplying one-twelfth of the fee prescribed in Schedule A in respect of those number-plates by the number of whole months remaining in the unexpired period of the registration to which the number-plates relate,” and by inserting instead the words “in accordance with the formula set out in clause (2)”;

(b) by inserting at the end of Regulation 5C the following clauses:

(2) The amount of refund is calculated in accordance with the

formula;

R is the amount of the refund;
F is the amount of the fee that has been paid pursuant to
Regulation 5B (1);

M is the number of whole months remaining in the

unexpired period of the registration to which the

number-plates relate; and

T is the total number of whole months of the period of
registration to which the number-plates relate.

(3) If an amount of refund determined in accordance with clause (2) would comprise an amount which is not a whole number of dollars, the amount of refund is to be adjusted downwards to the next whole number of dollars.

(c)

by omitting Schedule A and by inserting instead the following Schedule:

EXPLANATORY NOTE

This Regulation increases fees payable in connection with the administration of

the Traffic Act 1909, in line with the general movement in prices.

This Regulation also:

(a) provides for a formula for the calculation of the refund of fees paid for certain number-plates and for the refund to be adjusted downwards in the same way as in Regulations 5A and 5AA of the Motor Traffic Regulations 1935; and
(b) effects amendments consequent on previous amendments to the Motor Traffic Regulations 1935 relating to certain traffic control signs applying to both trucks and buses.
