TRAFFIC ACT 1909—REGULATION

(Relating to enforcement of loading offences)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

The Motor Traffic Regulations 1935 are amended by inserting after

Regulation 130A (1) (f2) the following word and paragraph:

; and

(f3) an employee of a council of a local government area who is an authorised person (within the meaning of the Local Government Act 1993) for the purposes of section 679 of that Act (Penalty notices for certain offences) is a prescribed officer in respect of an offence arising under Regulation 118A (Requirements as to certain loadings); and

EXPLANATORY NOTE

The object of this Regulation is to make it possible for enforcement officers employed by councils to issue penalty notices for offences under Regulation 118A of the Motor Traffic Regulations 1935 (which requires loads on motor vehicles and trailers

to be properly secured).

This Regulation is made under the Traffic Act 1909, in particular section 18B (Penalty notices for certain offences) and section 3 (the general regulation making power).
