TRAFFIC ACT 1909—REGULATION
(Relating to enforcement of certain parking offences)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

The Motor Traffic Regulations 1935 are amended by omitting
Regulation 130A (1) (g) and by inserting instead the following paragraph:
(g) the following persons are prescribed officers in respect of an offence against Regulation 54 (7) by virtue of a failure to comply with a traffic control sign referred to in Regulation 54 (6) (ao) (restricted parking area): (i) a person who is employed in a Government department
(being a Government department that is authorised in writing by the Commissioner of Police for the purposes of this paragraph) or subject to the control and direction of the head of such a Government department, and who is authorised by the department or the head of the department to issue penalty notices;
(ii) a person who is employed by a corporation established by or under an Act (being a corporation that is authorised in writing by the Commissioner of Police for the purposes of this paragraph) or subject to the control and direction of such a corporation, and who is authorised by the corporation to issue penalty notices;

(iii) a person who is subject to the control and direction of the Darling Harbour Authority as an enforcement officer.
EXPLANATORY NOTE
The object of this Regulation is to make it possible for authorised officers of Government departments and statutory corporations to issue penalty notices for offences arising from failure to comply with restricted parking area signs. This will apply only in respect of Government departments and statutory corporations that are authorised by the Commissioner of Police for the purposes of this Regulation.
This Regulation is made under the Traffic Act 1909, in particular section 18B (Penalty notices for certain offences) and section 3 (the general regulation making power).
