TRAFFIC ACT 1909—REGULATION
(Relating to driving unregistered motor vehicles)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1 December 1995.
Amendments
2. The Motor Traffic Regulations 1935 are amended:
(a) by omitting from Regulation 34 ( 1) (1) the words “of the vehicle (other than a renewal of registration)” and by inserting instead the words “or a renewal of registration of the vehicle”; (b) by omitting Regulation 34 (1) (1) (vi) and by inserting instead the following paragraphs: (vi) to the nearest convenient office of a licensed insurer under the Motor Accidents Act 1988, for the purpose of obtaining third party insurance for the vehicle in accordance with that Act; or
(vii) to the nearest convenient location for any other purpose directly associated with the registration process.

EXPLANATORY NOTE
At present the Motor Traffic Regulations 1935 allow an unregistered motor vehicle to be driven on a public street for the purpose of effecting registration of the vehicle (but not renewal of registration) to specified places (such as a motor registry) and for any other essential purpose directly associated with the registration process.
The objects of this Regulation are:
(a) to allow an unregistered motor vehicle to be driven on a public street for the purpose of effecting a renewal of the registration of the vehicle; and (b) to make it clear that the registration process extends to the obtaining of compulsory third party insurance in respect of a motor vehicle, so that an unregistered motor vehicle may be driven to the nearest convenient office of a licensed insurer for the purpose of obtaining such insurance; and
(c)
to refine the general exception relating to driving an unregistered motor vehicle for any other purpose associated with the registration process, to make it clear that it applies only to the driving of a motor vehicle to the nearest convenient location for that purpose.
This Regulation is made under section 3 of the Traffic Act 1909 (the general
regulation making power), in particular section 3 (I) (a) and (II).
