TRAFFIC ACT 1909 - REGULATION

(Relating to driving privileges of defence forces

personnel and their dependants)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Reguulation set forth hereunder.

Commencement

1. This Regulation commences on 5 October 1990.

Amendment

2. The Motor Traffic Regulations 1935 are amended by omitting Regulation 31 (1) (c) and by inserting instead the following paragraphs:

(c) a person:
(i) whose place of residence is in New South Wales; and

(ii)

who holds a valid Driver Identification Document issued by the Commonwealth Department of Defence; and

(iii)

who holds a licence to drive a motor vehicle, or the equivalent of such a licence, issued under the law in force in another State or Territory, being a licence (or the equivalent) which has not expired or been renewed

since the person took up residence in New South Wales;

or

(d) a person:
(i) whose place of residence is in New South Wales but who

has resided in New South Wales for less than 12 months;
and

(ii)          who holds a valid Driver Identification Document issued

by the Commonwealt Department of Defence; and

(iii)       who holds a licence to drive a motor vehicle, or the equivalent of such a licence, issued under the law in force in any place other than Australia, being a licence (or the equivalent) which has not expired or been renewed since the person took up residence in New South Wales.

EXPLANATORY NOTE

The object of this Regulation is to amend the law relating to the privileges accorded to defence forces personnel and their dependants with respect to driving in New South Wales. At present such persons, even though resident in New South Wales, are authorised for an indefinite period to drive in New South Wales without a New South Wales licence, as long as they have a current licence issued in another State or Territory of Australia or in another country.

The effect of the amendments on defence forces personnel and their dependants

is that:

(a) one who, in order to drive in New South Wales, relies on a licence issued in another Australian State or Territory may do so only until that licence expires; and
(b) one who, for that purpose, relies on a licence issued in another country may do so until that licence expires or until he or she has been resident in New South Wales for a period of 12 months, whichever sooner occurs.
