TRAFFIC ACT 1909—REGULATION

(Relating to a penalty imposed by penalty notices for road train route

infringements)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 1 November 1994.

Amendment

2. The Motor Traffic Regulations 1935 are amended:

(a) by inserting after Regulation 130A (1) (f) (iii) the following subparagraph:

(iv)  an offence arising under Regulation 113B (1) (a) in respect of standing or driving a road train that is longer than 23 metres on a public street that is not an approved route according to the conditions of the relevant permit under Regulation 113A; and

(b)

by omitting from Table A of Part 2 of Schedule K the matter relating to Regulation 113B (1) (a) and (b), 113B (2) and 113C (2) and by inserting instead the following matter:

(a)

in respect of the offence of standing or driving a road train that is longer than 23 metres on a public street that is not an approved route according to the conditions of the relevant permit under Regulation 113A ...................

EXPLANATORY NOTE

This Regulation amends the Motor Traffic Regulations 1935:

(a) to prescribe a separate penalty for penalty notices issued for the offence of

driving road trains on non-approved routes; and

(b)

to set that penalty at $750, instead of the present penalty of $99 (which will continue to apply for certain other road train offences); and

(c)

to add local council officers to the list of officers (presently police, Roads and Traffic Authority officers and Department of Transport officers) who have the power to issue penalty notices for driving road trains on non-approved routes.

This Regulation is made under section 18B (Penalty notices for certain offences) and

section 3 (Regulations) of the Traffic Act 1909.
