TRAFFIC ACT 1909—REGULATION

(Permitting certain RTA authorised vehicles to use bus lanes)

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the Traffic Act 1909, has been pleased to make the

Regulation set forth hereunder.

Commencement

1. This Regulation commences on 14th August, 1992.

Amendment

2. The Motor Traffic Regulations 1935 are amended by omitting

Regulation 54 (6) (z) and by inserting instead the following paragraph:

(z)

the words “bus lane” mean, and the direction represented by the traffic control sign on which those words appear is, that:

(i) the driver of a motor vehicle, other than:

(a) a motor omnibus, taxi-cab or private hire car; or

(b) a motor cycle; or

(c) a motor vehicle (whether a tow truck, a vehicle used for repairing traffic control light signals or another vehicle) being operated by or at the direction of the Authority and proceeding to an accident or other emergency,

who is approaching the traffic control sign from the direction in which it is facing and along a traffic lane adjacent to, above or on which the sign is erected, displayed or marked, must not:

(d) if the traffic lane is nearest to the boundary of the carriageway on the driver’s left-hand side, drive except in accordance with the direction on a traffic control sign provided pursuant to paragraph (aa1) or for a distance of not more than 100 m for the purpose of turning to the left at or before the next intersection on the driver’s left-hand side; or
(e) if the traffic lane is nearest to the boundary of the carriageway on the driver’s right-hand side, drive except in accordance with the direction on a traffic control sign provided pursuant to paragraph (aa1) or for a distance of not more than 100 m for the purpose of turning to the right at or before the next intersection on the driver’s right-hand side; or
(f) if the traffic lane is not adjacent to either boundary of the carriageway, drive except in accordance with the direction on a traffic control sign provided pursuant to paragraph (aa1) or for a distance of not more than 100 m for the purpose of turning at or before the next intersection in accordance with the direction on a traffic control sign provided pursuant to paragraph (t),

between that traffic control sign and the next traffic control sign bearing the words “end bus lane” erected, displayed or marked with respect to that traffic lane (or, where there is only the one sign erected, displayed or marked, between that sign and the intersection next after it in the direction in which the driver is proceeding), except for an urgent purpose arising from a medical or similar emergency; and

(ii) the driver of a motor vehicle, other than:

(a) a motor omnibus at an omnibus stopping glace; or

(b)

a taxi-cab or private hire car picking up or setting down a passenger; or

(c)

a motor vehicle (whether a tow truck, a vehicle used for repairing traffic control light signals or another vehicle) being operated by or at the direction of the Authority and attending an accident, breakdown, traffic control light signal failure or other emergency,

who is approaching the traffic control sign from the

direction in which it is facing and along a traffic lane adjacent to, above or on which the sign is erected, displayed or marked must not, if the traffic lane is nearest to the boundary of the carriageway on the driver’s left-hand side,

cause the motor vehicle to stop or wait between that trafflc control sign and the next traffic control sign bearing the words “end bus lane” erected, displayed or marked with respect to that traffic lane (or, where there is only the one sign erected, displayed or marked, between that sign and the intersection next after it in the direction in which the driver is proceeding), except for an urgent purpose arising from a medical or similar emergency; and

(iii) the driver of a motor vehicle, other than:

(a) a taxi-cab or private hire car picking up or setting down a passenger in a one-way traffic street; or
(b) a motor vehicle (whether a tow truck, a vehicle used for repairing traffic control light signals or another vehicle) being operated by or at the direction of the Authority and attending an accident, breakdown, traffic control light signal failure or other emergency,

who is approaching the traffic control sign from the direction in which it is facing and along a traffic lane adjacent to, above or on which the sign is erected, displayed or marked, must not, if the traffic lane is nearest to the boundary of the carriageway on the driver’s right-hand side, cause the motor vehicle to stop or wait between that traffic control sign and the next traffic control sign bearing the words “end bus lane” erected, displayed or marked with respect to that traffic lane (or, where there is only the one sign erected, displayed or marked, between that sign and the intersection next after it in the direction in which the driver is proceeding), except for an urgent purpose arising from a medical or similar emergency.

EXPLANATORY NOTE

The object of this Regulation is to mend the Motor Traffic Regulations 1935 to

enable tow-trucks and other service vehicles operated by or on behalf of the Roads

and Traffic Authority to use bus lanes when proceeding to accidents, breakdowns,

traffic light signal failures or other emergencies. Similar provisions already exist in
relation to transit lanes and “buses only” lanes.
