TRAFFIC ACT 1909—REGULATION

(Relating to roundabouts)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 22 March 1996.

Amendment of Motor Traffc Regulations 1935

2. The Motor Traffic Regulations 1935 are amended by inserting after

Regulation 54 (6) (aj) (ii) the following word and subparagraph:

and

(iii)  having entered the roundabout from a public street that has 2 or more traffic lanes which are lawfully available for traffic proceeding in the same direction:

(a) must not turn into another public street which, immediately before the driver entered the roundabout, was on the driver’s left-hand side, unless the driver entered the roundabout from the left-most traffic lane; and
(b) must not turn into another public street which, immediately before the driver entered the roundabout, was on the driver’s right-hand side or turn into the street from which the driver entered, unless the driver entered the roundabout from the right-most traffic lane.

This subparagraph does not apply to the extent that any traffic control sign or directional arrow at or near a roundabout indicates

that the driver must enter or leave the roundabout in a different

manner from that described in this subparagraph.

Amendment of General Traffic Regulations 1916
3. The General Traffic Regulations 19 16 are amended by inserting
after paragraph (6) (ag) (ii) of section 13A the following word and
subparagraph:

and

(iii)  having entered the roundabout from a public street that has 2 or more traffic lanes which are lawfully available for traffic proceeding in the same direction:

(a) must not turn into another public street which, immediately before the driver or rider entered the roundabout, was on the driver’s or rider’s left-hand side, unless the driver or rider entered the roundabout from the left-most traffic lane; and
(b) must not turn into another public street which, immediately before the driver or rider entered the roundabout, was on the driver’s or rider’s right-hand side or turn into the street from which the driver or rider entered, unless the driver or rider entered the roundabout from the right-most traffic lane.

This subparagraph does not apply to the extent that any traffic control sign or directional arrow at or near a roundabout indicates that the driver or rider must enter or leave the roundabout in a different manner from that described in this subparagraph.

EXPLANATORY NOTE

The object of this Regulation is to establish the appropriate way to enter and leave a roundabout when approaching the roundabout from a street that has more than one traffic lane available for traffic proceeding in the same direction. The Regulation provides that a driver or rider must not turn left at such a roundabout (that is, turn into a street that, immediately before he or she entered the roundabout, was on his or her left-hand side) unless the driver or rider enters the roundabout from the left-most traffic lane. Conversely, a driver or rider must not turn right at the roundabout, or go around the roundabout and exit to the street from which he or she entered, unless he or she enters the roundabout from the right-most lane. The new rule does not apply to the extent that any traffic control sign or directional arrow at or near the roundabout indicates that a different course must be taken by the driver or rider.

This Regulation is made under the Traffic Act 1909, including section 3 (the general regulation making power), particularly section 3 (1) (a), (o4) and (p).
