TRAFFIC ACT 1909—REGULATION

(Relating to the manner of indicating restrictions applying to parking bays in

shared traffic zones and restricted parking areas)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

The Motor Traffic Regulations 1935 are amended:

(a) by omitting the definition of ‘‘Parking Bay” from Regulation 2 (1) and by inserting instead the following definition:

“Parking Bay” means that portion of a shared traffic zone or restricted parking area in which a vehicle may stand or be parked, as indicated by:

(a) lines marked on the pavement with the approval of the Authority by means of studs, plates, markers, paint, lacquer, plastic substance or similar objects or material or by the use of a coloured or textured surface different from the rest of the shared traffic zone or restricted parking area; and
(b) any one of the following:

(i)   the letter “P” marked on the pavement in the manner referred to in paragraph (a) within the area demarcated by she lines:

(ii)  directions marked, with the approval of the Authority, on the pavement in the manner referred to in paragraph (a) within the area demarcated by the lines;

(iii)  directions marked, with the approval of the Authority, on a sign displayed, with the approval of the Authority, adjacent to the area demarcated by the lines;

(b)

by omitting from Regulation 54 (6) (ao) the words “marked on a parking bay” and by inserting instead the words “marked on (or on a sign displayed, with the approval of the Authority, adjacent to) a parking bay”.

EXPLANATORY NOTE

The object of this Regulation is to amend the Motor Traffic Regulations 1935 to prescribe an alternative method of indicating the lawful use of a parking bay in a shared traffic zone or restricted parking area. At present, the law requires that directions governing the use of a parking bay be written on the ground or floor of the bay itself. This Regulation amends the law so as to allow the directions to be marked instead on a sign displayed adjacent to the parking bay.

The Regulation is made under section 3 (and in particular section 3 (1) (h)) of the

Traffic Act 1909.
