TRAFFIC ACT 1909—REGULATION

(Relating to law revision)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 19 January 1996.

Amendments

2. The Motor Traffic Regulations 1935 are amended:

(a)

by omitting the definition of “prescribed deceleration” from Regulation 11 8A (1) and by inserting instead the following definition:

“prescribed acceleration” means (where “g” (the acceleration

due to gravity) equals 9.81 metres per second per second):

(a)

in the case of a deceleration in a forward direction: 0.8g; or

(b)

in the case of a deceleration in a rearward direction: 0.5g; or

(c)

in the case of an acceleration in a lateral direction: 0.5g; or

(d)

in the case of an acceleration relative to the load in a vertical direction: 0.2g;

(b)

by inserting the term “motor vehicle” in alphabetical order in the lists of terms in the notes that immediately follow each of the headings to Parts 1–9 of the Appendix to Division 7 of Schedule F:

(c) by inserting the term “trailer” in alphabetical order in the lists of terms in the notes that immediately follow each of the headings to Parts 1–6 and 9 of the Appendix to Division 7 of Schedule F;
(d) by omitting the word “vehicle” and by inserting instead the words ‘`motor vehicle” in the following provisions (and positions) of the Appendix to Division 7 of Schedule F:

EXPLANATORY NOTE

The object of this Regulation is to revise the use of the expressions ”vehicle” and “motor vehicle” in the National Heavy Vehicle Standards set out as part of Schedule F to the Motor Traffic Regulations 1935. This Regulation also amends the concept of “prescribed deceleration” in line with the national guide on load restraints and sets out a clearer diagram of a 75 millimetre kingpin in those Regulations.

This Regulation is made under section 3 of the Traffic Act 1909.
