Explanatory note

The object of this Regulation is to amend the Motor Traffic Regulations 1935 so that small box trailers that are exempt from registration in Victoria may travel in New South Wales as visiting motor vehicles so long as they are being towed by vehicles that are registered in Victoria and comply with certain other specified requirements.

This Regulation is made under the Traffic Act 1909, including sections 3 (11) and 6.

1 Name of Regulation

This Regulation is the Motor Traffic Amendment (Visiting Motor

Vehicle) Regulation 1997.

2 Amendment of Motor Traffic Regulations 1935

The Motor Traffic Regulations 1935 are amended as set out in

Schedule 1.

(Clause 2)

[1]        Regulation 33A Visiting and other motor vehicles

Insert after Regulation 33A (1) (e):

( f ) any trailer (other than a trailer used to carry a boat) that:
(i) satisfies the prescribed requirements, and
(ii) is being towed by a motor vehicle that is registered in Victoria, and
(iii) if it obscures the number-plate of that motor vehicle, displays (whether by painting or otherwise) on its rear the registration number of the vehicle so that the number is clearly distinguishable at a distance of 20 metres from the rear.

[2]        Clause 33A (4)

Insert after 33A (3):

(4) In this Regulation, the prescribed requirements in
relation to a trailer are that the trailer:
(a) is not used in the course of trade, and
(b) is exempt from registration in Victoria, and
(c) weighs less than 200 kilograms unladen, and
(d) has a manufactured width that does not exceed the width of the vehicle towing the trailer, and
(e) is of a length (including the draw bar and any load) that does not exceed 3 metres.
