Explanatory note

The object of this Regulation is to provide for a scheme under which vehicles standing in certain loading zones (ticket-operated loading zones) will be required to display tickets authorising them to do so. The tickets will be available free of charge and will specify the expiry time of the vehicles authorisation to stand in such a zone.

This Regulation also makes amendments to Schedules K and L to the Motor Traffic Regulations 1935 by way of law revision in consequence of the enactment of section 4A (1B) of the Traffic Act 1909. That subsection was inserted by the Traffic Amendment (Penalties and Disqualifications) Act 1998 and commenced on 30 September 1998.

This Regulation is made under the Traffic Act 1909, and, in particular, under sections 3 (the general relation-making power), 4A (Speed limits) and 4D (Traffic control signs).

1 Name of Regulation

This Regulation is the Motor Traffic Amendment (Ticket-operated

Loading Zones) Regulation 1999.

2 Commencement

This Regulation commences on 12 February 1999.

3     Amendment of Motor Traffic Regulations 1935

The Motor Traffic Regulations 1935 are amended as set out in

Schedule 1.

The explanatory note does not form part of this Regulation.

Insert after Regulation 54 (6) (n):

(naa) the word "ticket", appearing after or below the words "loading zone", means that in the loading zone to which the sign relates, a period of time referred to in paragraph (n) (i) or (ii) is to be reckoned in accordance with Regulation 91VB (a), and the direction referred to in that paragraph is modified in the manner provided by Regulation 91VB (b),

91VA Definitions

In this Division:

goods vehicle means a motor vehicle constructed
principally for the conveyance of goods.

loading zone ticket means a ticket issued by or on behalf of the Authority (by means of a loading zone ticket machine) for display in or on a goods vehicle as evidence of the period during which the vehicle has been standing in a ticket-operated loading zone.

loading zone ticket machine means a device designed to issue loading zone tickets, and includes the stand on which such a device is erected.

ticket-operated loading zone means a loading zone distinguished by the fact that the word "ticket" appears after or below the words "loading zone" on the traffic control sign by which the zone is designated and by the fact that a loading zone ticket machine is situated at or near the zone.

91VB Ticket-operated loading zones

In a ticket-operated loading zone:

a period of time prescribed by Regulation 54 (6) (n) (i) or (ii) as the period for which a goods vehicle of a class to which the relevant subparagraphs applies may be caused to stand in the loading zone is taken to be the period that ends at the time shown, on a ticket displayed in or on the vehicle in accordance with paragraph (b) (i), as the expiry time for vehicles of that class, and
the direction referred to Regulation 54 (6) (n) is
taken to include the further stipulations that:
(i) the driver of a vehicle may cause the vehicle to stand in the zone only while a loading zone ticket is prominently displayed (in such a way that the date and the expiry times shown on the ticket are not obscured) in or on the front left-hand portion of the vehicle (or, if the driver so chooses, in such other position as the Authority may, by notice published in the Gazette, from time to time approve), and
(ii) the driver must not allow the vehicle to remain standing in the zone after the expiry time shown on the ticket in respect of goods vehicles of the class to which the vehicle belongs.

91VC Loading zone ticket machines

(1) Tickets issued by a loading zone ticket machine are to be
free of charge.

(2)

A loading zone ticket is to differentiate between the 2 classes of goods vehicles mentioned in Regulation 54 (6) (n) (i) and (ii) by specifying an expiry time:

(a)

that, in relation to a goods vehicle mentioned in Regulation 54 (6) (n) (i), is 30 minutes after the time of its issue, and

(b)

that, in relation to a goods vehicle mentioned in Regulation 54 (6) (n) (ii), is 15 minutes after the time of its issue.

(3) A person must not:

(a)

deface any loading zone ticket machine or affix anything (such as advertising material) to, any loading zone ticket machine, or

(b)

intentionally cause any loading zone ticket machine to produce more than one ticket on any one occasion (except for the purpose of obtaining a ticket that is not mutilated or illegible), or

(c)

interfere with any loading zone ticket machine, unless lawfully authorised to do so.

91VD lnformation on loading zone tickets

(1) The following information must be printed on a loading
zone ticket:

(a)

the name of the Authority as the body by or on whose behalf the ticket is issued,

(b) a serial number,
(c) instructions for use of the ticket,
(d) the day of the week on which the ticket is issued,

(e)

the date (expressed as the day of the month, the month and the year) on which the ticket is issued,

(f)

details of the 2 classes of goods vehicles to which the ticket relates (being the classes mentioned in Regulation 54 (6) (n) (i) and (ii)),

(g)

the different expiry times for those 2 classes of goods vehicles.

(2)

A loading zone ticket must be legible and of a size and design that enables it to be easily displayed in or on a goods vehicle.

91VE Use of loading zone tickets for standing in
ticket-operated loading zones

(1)

A person does not commit an offence under these Regulations if the person allows a goods vehicle to stand in a ticket-operated loading zone before obtaining a loading zone ticket, so long as the person, immediately after allowing the goods vehicle so to stand, obtains such a ticket from a loading zone ticket machine and displays it in accordance with these Regulations.

(2)

The driver of a goods vehicle must not replace a loading zone ticket in or on the vehicle (whether or not either of the expiry times shown on the ticket has been reached) with a fresh loading zone ticket (or otherwise display a fresh loading zone ticket in or on the vehicle) for the purpose of allowing the vehicle to remain standing in the ticket-operated loading zone after the expiry time specified in the first loading zone ticket for the relevant class of goods vehicle.

A person must not display in or on a goods vehicle that is standing in a ticket-operated loading zone:

(a) any article or thing resembling a loading zone ticket that falsely suggests that the relevant goods vehicle is standing lawfully in the ticket-operated loading zone, or
(b) any loading zone ticket that is altered, defaced, mutilated or illegible, or
(c) more than 2 loading zone tickets showing expiry times that have been reached as well as a loading zone ticket showing an expiry time that has not been reached.

Omit paragraphs (a) and (b) of the matter relating to section 4A (1) from Table B of Part 1.
