Motor Traffic Amendment (Speed

Limit Signs) Regulation 1996

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Trafflc Act 1909.

Explanatory note

The object of this Regulation is to change signs relating to school zones from being traffic control signs to being speed limit signs. This will result in more serious penalties applying for a breach of the speed limit indicated on such a sign.

The Regulation also prescribes signs indicating local traffic zones as speed limit signs and enables such signs to be erected so as to indicate the speed limit applicable within a network of public streets.

A minor change to the existing speed limit sign is also included. general regulation-making power) and section 4A.

Regulation 1996

1 Name of Regulation

This Regulation is the Motor Traffic Amendment (Speed Limit

Signs) Regulation 1996.

2 Commencement

This Regulation commences on 1 December 1996.

3 Amendment of Motor Traffic Regulations 1935

The Motor Traffic Regulations 1935 are amended as set out in

Schedule 1.

The explanatory note does not form part of this Regulation.

Omit Regulation 54A (1), Insert instead:

(1)

The sign to indicate a length of public street to which a speed limit fixed under section 4A (3) of the Act applies is to be in or to the effect of the form illustrated and described in Diagram 1, 3, 5 or 6 in the Schedule to this Regulation.

(1A) The sign is to display figures indicating the speed so
fixed (whether or not the relevant Diagram in the
Schedule to this Regulation contains different figures).

Amendments Schedule 1
(1 B) A speed limit indicated by a sign in or to the effect of the form illustrated and described i n Diagram 3 of the Schedule to this Regulation has effect, during the times of day indicated on the sign, on any school days (that is, any days other than Saturdays, Sundays and public holidays or days publicly notified as school holidays for government schools).

Omit Regulation 54A (3). Insert instead:

(3)

Clause (2) does not apply to a sign in or to the effect of the form illustrated and described in Diagram 5 or 6 in the Schedule to this Regulation if:

(a)

the sign is erected or displayed to indicate the speed limit applicable to any length of public street in a network of 2 or more public streets, and

(b)

the sign is erected or displayed on or near, or marked on, each of the public streets that provides access to that network of public streets in such a position as to be clearly visible to the driver of an approaching motor vehicle, and

(c)

a sign in or to the effect of the form illustrated and described in Diagram 7 or 8 in the Schedule to this Regulation is erected or displayed on or near each of the public streets that provides an exit from that network of public streets in such a position as to be clearly visible to the driver of an approaching motor vehicle who is leaving that network of public streets.

(4)

The sign illustrated and described in Diagram 2 in the Schedule to this Regulation indicates the end of a length of public street in respect of which a speed limit has been fixed under section 4A (3) of the Act as indicated by a sign illustrated and described in Diagram 1 in the Schedule to this Regulation.

(5)

The sign illustrated and described in Diagram 4 in the Schedule to this Regulation indicates the end of a length of public street in respect of which a speed limit has been fixed under section 4A (3) of the Act as indicated by a sign illustrated and described in Diagram 3 in the Schedule to this Regulation.
