Motor Traffic Amendment (Special

Event Parking) Regulation 1998

under the

Traffic Act 1909

His Excellency the Governor, with the advice of the Executive Council, has

made the following Regulation under the Traffic Act 1909.

Explanatory note

The object of this Regulation is to provide for the designation of special event parking areas, in the vicinity of major sporting or entertainment venues, that will have parking restrictions operating during special events. The Regulation also enables the issue of special event parking permits that exempt holders from the general parking restrictions operating in special event parking areas.

This Regulation is made under the Traffic Act 1909, including sections 3 and

4D.

1 Name of Regulation

This Regulation is the Motor Traffic Amendment (Special Event

Parking) Regulation 1998.

2 Amendment of Motor Traffic Regulations 1935

The Motor Traffic Regulations 1935 are amended as set out in

Schedule 1.

The explanatory note does not form part of this Regulation.

[ l ] Regulation 2 Definitions
Insert in alphabetical order in Regulation 2 (l):

Special event parking area means an area designated as a special event parking area in accordance with Regulation 91EEA.

Insert at the end of Regulation 54 (6) (a1):

This subparagraph does not apply to a traffic control sign in or in a form similar to the form illustrated in Diagram
54 in the Schedule to this Regulation.

Insert after Regulation 54 (6) (ap):

(aq) the words "special event parking area" (if the traffic control sign on which they appear is in or in a form similar to the form of the sign illustrated in Diagram 54 in the Schedule to this Regulation) have the meaning, and the direction represented by the traffic control sign is the direction, set out in Regulation 91EEA (2),

91EEA Special event parking areas

(1) An area is designated as a special event parking area i f
(a)

there is erected or displayed on or near, or marked on, each of the public streets that provides access to that area a traffic control sign of a kind illustrated by Diagram 54 in such a position as to be clearly visible to the driver of an approaching motor vehicle, and

(b)

there is erected or displayed on or near, or marked on, each of the public streets that provides an exit to that area a traffic control sign of a kind illustrated by Diagram 55 in such a position as to be clearly visible to the driver of an approaching motor vehicle who is leaving that area.

The words "special event parking area" appearing on a
traffic control sign of a kind illustrated by Diagram 54

mean, and the direction represented by the sign is, that the driver of a vehicle who approaches that sign from the direction in which it is facing must not, on a length of public street in any special event parking area between that sign and any traffic control sign of a kind illustrated by Diagram 55 facing the driver on which appear the words "end special event parking area", cause the vehicle to stand or wait or be parked:

( a )

in a case where the relevant length of public street is subject to parking restrictions in accordance with other provisions of these Regulations (for

example, a parking restriction imposed by Regulation 84 (I) or by means of a period parking sign as defined in Regulation 91C)-in contravention of those restrictions, or

(b)

in a case where the relevant length of public street is not subject to such parking restrictions-for r a period exceeding the period of time indicated by the numeral representing the time restriction (in hours) before the symbol “P” on the Diagram 54 traffic control sign during the times and days shown on that sign.

(3) Clause (2) (b) does not apply to:
(a) a vehicle that is a public utility service vehicle, or

(b)

a driver who is the holder of a special event parking permit issued under Regulation 91CA in relation to the relevant special event parking area and who is complying with the conditions of the permit, or

(c)

a driver who is actually engaged in taking up or setting down persons or goods.

(4)

A reference in this Regulation to a Diagram is a reference to a Diagram in, or in a form similar to, that Diagram where appearing in the Schedule to Regulation 54.
