Explanatory note

The object of this Regulation is to exempt persons from having to comply with certain requirements relating to registration of, and affixing of number-plates to, a vehicle while travelling on a public street, if the vehicle is attached to a rural fire brigade and is being used for specified purposes relating to the functions of the NSW Rural Fire Service.

This Regulation is made under the Traffic Act 1909, including section 3 (the general regulation-making power).

Name of Regulation

This Regulation is the Motor Traffic Amendment (Rural Fire

Brigade Vehicles Exemption) Regulation 1998.

Amendment of Motor Traffic Regulations 1935

The Motor Traffic Regulations 1935 are amended as set out in

Schedule 1 .

(Clause 2)

Regulation 34 Other exemptions from registration, licensing etc.

Omit Regulation 34 (1) (a1). Insert instead:

(a1)

section 6 (1) (c) (v) of the Act, and the provisions of these Regulations relating to the affixing of number-plates or numbers on motor vehicles, in respect of any motor vehicle travelling on a public street if that vehicle:

( i )

is attached to a rural fire brigade formed under the Rural Fires Act 1997 and has painted on i t , or securely affixed to it, a sign clearly identifying the rural fire brigade to which it is attached, and

(ii)

is used to convey persons or equipment to or from the work of preventing, mitigating or suppressing fires in rural fire districts (including clearing fire breaks or removing inflammable material), and

(iii)

is travelling on the public street for the purpose referred to in subparagraph (ii) or any of the following purposes:

( A ) to attend a fire, incident or other

emergency in accordance with the

Rural Fires Act 1997,

( B ) to assist other emergency services organisations at incidents and at emergencies under the control of those organisations,

( C ) to convey persons or equipment for

the purpose of training those persons

in relation to any of the purposes

referred to i n this subparagraph,

( D ) f o r a purpose necessary or incidental
to the service or repair of the vehicle,

Schedule 1 Amendment

(E)

to perform such other functions of the NSW Rural Fire Service as the Commissionerof the NSW Rural Fire Service or a fire control officer appointed under the Rural Fires Act

1997 may approve for the purposesof
the exemption.
