Motor Traffic Amendment (Removal of Unattended hicles) Regulation 1998

Traffic Act 1909

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Traffic Act 1909.

The object of this Regulation is to amend the Motor Traffic Regulations 1935 so as to prescribe bus lanes and buses only lanes as prescribed places

for the purposes of section 26 of the Traffic Act 1909. The amendments will enable an authorised officer within the meaning of that section to cause an unattended motor vehicle unlawfully standing on a bus lane or buses only lane to be removed in accordance with that section if, in the opinion of the authorised officer, the motor vehicle is causing or is likely to cause danger to the public or undue traffic congestion.

This Regulation is made under the Traffic Act 1909, including sections 3 (the general regulation-making power) and 26 (1).

1 Name of Regulation
This Regulation is the Motor Traffic Amendment (Removal of
Unattended Vehicles) Regulation 1998.

2 Amendment of Motor Traffic Regulations 1935

The Motor Traffic Regulations 1935 are amended as set out in

Schedule 1.

The explanatory note does not form part of this Regulation.

Regulation 140A

Insert after Regulation 140:

140A Removal of unattended motor vehicles: section 26

For the purposes of section 26 (1) of the Act, a bus lane and a buses only lane are prescribed places.
