Parking and Licence Classes)

Regulation 1999

Traffic Act 1909

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Traffic Act 1909.

Explanatory note
The objects of this Regulation are:
(a) to allow a motor vehicle used by a police officer in the course of his or her duty to be driven onto and parked on a traffic island or median strip when the police officer is carrying out enforcement, surveillance or observation duties, and
(b) to remove references to an “articulated vehicle” from a provision of the Motor Traffic Regulations 1935 dealing with classes of licences so as to standardise these classes with national licensing classes.
The Regulation also makes minor amendments regarding offences and penalties in relation to defect notices.
This Regulation is made under the Traffic Act 1909, including section 3 (the general regulation-making power).

1 Name of Regulation

This Regulation is the Motor Traffic Amendment (Police Parking and Licence Classes) Regulation 1999.

2     Amendment of Motor Traffic Regulations 1935

The Motor Traffic Regulations 1935 are amended as set out in

Schedule 1.

The explanatory note does not form part of this Regulation.

Schedule 1 Amendments

(Clause 2)

[1]        Regulation 8 Classes of licences

Omit paragraph (a) (i) of the matter relating to Class MR (Medium rigid vehicle) in Regulation 8 (1).

Omit paragraph (a) (i) of the matter relating to Class HR (Heavy rigid vehicle).

[3]        Regulation 66D Driving on median strip or traffic island

Insert after Regulation 66D (3):

(4) Nothing in clause (1) applies to the driving of a motor vehicle being used by a police officer in carrying out enforcement, observation or surveillance duties.

[4]        Regulation 84 Standing of vehicles in certain positions

Insert after Regulation 84 (2):

(3) Clause (1) (j) does not apply to the standing of a motor vehicle or trailer being used by a police officer in carrying out enforcement, observation or surveillance duties.

[5] Schedule K Prescribed offences and penalties for the purposes of section 18B of the Act

Insert in Part 13 of Schedule K after the matter relating to clause 57 (1) (b) of the Road Transport (Vehicle Registration) Regulation 1998:
