His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Traffic Act 1909.

The object of this Regulation is to remove certain provisions of the principal Regulation relating to registration, inspections and vehicle standards of vehicles. These amendments are consequential on the commencement of the
Road Transport (Vehicle Registration) Act 1997 and the Road Transport (Vehicle Registration) Regulation 1998, both of which will regulate
registration. inspections and vehicle standards of vehicles. example, the Regulation makes amendments to Regulations 61 and 8 1A of the Motor Traffic Regulations 1935 to ensure that those provisions will continue to extend to trailers after the commencement of the Traffis Legislation Amendment Act 1997 (which will commence at the same time as this Regulation). The Regulation also replaces Regulation 32C exempting certain golf vehicles from section 6 (1) of the Traffic Act 1909 with a provision that is consistent with the new terminology concerning roads and road related areas to be inserted in that Act on the commencement of the
Traffic legislation Amendment Act 1997.
This Regulation is made under the Traffic Act 1909, including section 3 ( 1 )
(the general regulation-making power).

This Regulation is the Motor Traffic Amendment (Law Revision)

Regulation 1998.

2 Commencement

This Regulation commences on 29 June 1998.

3 Amendment of Motor Traffic Regulations 1935

The Motor Traffic Regulations 1935 are amended as set out in

Schedule 1 .

4 Notes

The explanatory note does not form part of this Regulation.

Schedule 1 Amendments

Insert in appropriate alphabetical order:

Bicycle rack has the same meaning as it has in the Road

Transport (Vehicle Registration) Regulation 1998.

Bicycle rack number-plate has the same meaning as it

has in the Road Transport (Vehicle Registration)

Regulation 1998.

Golf course means an area of land (which includes tees. fairways, greens, rough, pathways, bunkers and bridges) designed and used for the playing of golf.

Motor registry means a place at which registration of a

vehicle or the licensing of drivers can be effected by or

on behalf of the Authority.

Number-plate means a number-plate for a vehicle or

bicycle rack issued under the Road Transport (Vehicle
Registration) Act 1997 and the regulations under that

Act.

Registered operator has the same meaning as i t has in the Road Transport (Vehicle Registration) Act 1997.

Registration label means a registration label issued

under the Road Transport (Vehicle Registration) Act

1997 and the regulations under that Act.

4 Applications for licences

An applicant for the issue or renewal of a licence must:

(a)

make a written application in the form provided, and

(b) sign the form, and

(c)

pay the appropriate fee (if any) prescribed in Schedule A.

The Authority may, in such cases as i t thinks fit, waive the appropriate fee in respect of a licence that is issued to
an applicant who is, at the time of making the application
for the issue of the licence, the holder of a licence to drive a motor vehicle, or the equivalent of such a licence, issued under the law in force in another State or Territory.

Regulation 5 Payment of fees by pensioners

Omit Regulation 5 (2) and (2A). Insert instead:

The prescribed fee for a licence is not payable by a pensioner in respect of a licence issued to the pensioner.

5A Refunds of licence fees

( 1 ) If a person to whom a motor vehicle driver's licence has
been issued:
(a) becomes eligible for a concession in respect of the licence, or
(b) surrenders the licence to the Authority before the date of its expiration, or
(c) has his or her licence cancelled by the Authority before the date of its expiry.
the Authority may make a partial refund of any
prescribed fee paid for the licence.
( 2 ) A partial refund of a prescribed fee paid for a licence is
calculated using the formula:

fee is the amount of the prescribed fee.

(3) I f an amount of refund determined in accordance with
clause (1) would comprise an amount that is not a whole
amount of dollars, the amount of refund is to be adjusted

7 Duration of licence

    32C Exemption:Golf and green keeping vehicles used on

    roads or road related areas

(1)

A person is exempted from the requirements of section 6 (1) of the Act in respect of the driving of any golf vehicle or green keeping vehicle directly across a road or road related area that intersects with or traverses a golf course if the vehicle:

(a)

is being used in the course of, or as an incident to. a game of golf or to observe any such game, or

(b)

is proceeding to or from the golf course to be used for or in connection with the rolling or maintenance or surface improvement of any part of the golf course, or

(c)

is proceeding to or from a car park or storage building that is separated from the golf course by the road or road related area.

( 2 ) In this Regulation:
golf vehicle means:

( a )

a motorised buggy or cart that is designed and used to carry any golfer, spectator or golfing equipment on a golf course, or

( b )

a motor cycle having an engine capacity not exceeding so ml that is used to carry a golfer, spectator or golf equipment on a golf course, or

(c) any trailer that is being drawn by any such vehicle.
green keeping vehicle means any vehicle used solely or

principally for or i n connection with the rolling or maintenance or surface improvement of any part of a golf course.

(iii) not capable of travelling at more than 10

km/h.

( i i )       while a boat is not being carried on the trailer-securely affixed to the trailer in such a manner that the lamp, reflector or flashing light turn signal is in a position and is facing in a direction which complies with the provisions of these Regulations.
