His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Traffic Act 1909.

Explanatory note

The object of this Regulation is to apply to drivers of all heavy vehicles the option of taking two 15-minute rest breaks instead of one 30-minute rest break in every driving period of 5 hours 30 minutes. At present this option is open only to drivers of coaches.

This Regulation is made under the Traffic Act 1909, including section 3 (1)

(t1).

Regulation 1997

1 Name of Regulation

This Regulation is the Motor Traffic Amendment (Driving Hours)

Regulation 1997.

2 Commencement

This Regulation commences on 11 April 1997.

3 Amendment of Motor Traffic Regulations 1935

The Motor Traffic Regulations 1935 are amended as set out in

Schedule 1.

4 Notes

The explanatory note does not form part of this Regulation.

Schedule 1 Amendment

(Clause 3)

Regulation 126A Hours of driving and rest period requirements

Omit Regulation 126A (1) and (1A).

Insert instead:

(1) A person must not drive, during any period of 5 hours and 30 minutes, a motor vehicle or motor vehicles to which this Part applies without taking during that period a break of at least 30 minutes duration (or two breaks, each of at least 15 minutes duration):
(a) in a stationary vehicle, or
(b) in the sleeper-cab of a vehicle, or
(c) away from motor vehicles to which this Part applies.
(1A) Regulation 125 (2) (f) does not apply to either of the two
breaks of at least 15 minutes duration referred to in
clause (1).
