His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Traffic Act 1909.

Explanatory note
The object of this Regulation is to prohibit the standing or driving of a motor vehicle on a public street if a child is occupying a child restraint in a front seat position of the vehicle and an airbag fitted to the vehicle is designed to deploy in that seat position.
This Regulation is made under the Traffic Act 1909, including section 3 (the general regulation making power, in particular section 3 (1) (a), (i), (q) and (u)).

Airbags) Regulation 1996
1 Name of Regulation
This Regulation is the Motor Traffic Amendment (Child
Restraints and Airbags) Regulation 1996.
2 Commencement
This Regulation commences on 1 October 1996.
3 Amendment of Motor Traffic Regulations 1935
The Motor Traffic Regulations 1935 are amended as set out in
Schedule 1.

The explanatory note does not form part of this 'Regulation.

Regulation 110H
Insert after Regulation 110GB:
110H Child restraints prohibited on front seats fitted with
airbags
(1)
A person must not stand or drive a motor vehicle on a public street if a child is occupying a child restraint in a front seat position of the vehicle and an airbag fitted to the vehicle is designed to deploy in that seat position.
(2)
The Authority may, subject to such conditions as i t thinks fit, exempt any person or class of persons, or any motor vehicle or class of motor vehicles, from the operation of this Regulation.

Amendment of Motor Traffic Regulations 1935 Schedule 1
(3) In this Regulation: child means a person under 14 years of age. child restraint means any restraint or similar device that is designed to restrain or limit the movement of a child occupying the restraint in a motor vehicle if the vehicle suddenly accelerates or decelerates, but does not include a seat belt.
