Explanatory note
The objects of this Regulation are to fix a speed limit of 40 kilometres per hour for motorists approaching or overtaking a school bus in certain circumstances and to make provision with respect to the meaning of related road signs.
This Regulation is made under sections 3 (the general regulation-making power) and 4A (speed limits) of the Traffic Act 1909.

1 Name of Regulation
This Regulation is the Motor Traffic Amendment (Additional
School Bus Warning System and Signs) Regulation 1998.
2 Commencement
This Regulation commences on 25 January 1999.

Schedule 1.

[1] Regulation 54A Speed limit signs
Omit “and described” wherever occurring.
[2] Regulation 54A (1)
Omit “or 6”. Insert instead “, 6 or 9”.
[3] Regulation 54A (1C)
Insert after Regulation 54A (1B):
(1C) A speed limit indicated by a sign in or to the effect of the form illustrated in Diagram 9 in the Schedule to this Regulation has effect only while a bus with a warning system referred to in Regulation 136A that is activated is between that sign and a sign in or to the effect of the form illustrated in Diagram 10 in that Schedule.

The sign illustrated in Diagram 10 in the Schedule to this Regulation indicates the end of a length of road or road related area in respect of which a speed limit has been fixed under section 4A (3) of the Act as indicated by a sign illustrated in Diagram 9 in the Schedule to this Regulation.

[6] Regulation 136D
Insert after Regulation 136C:
136D School bus warning and 40 km/h speed limit
( 1 )
The driver of a motor vehicle approaching from the rear a bus (whether stationary or in motion) on which is displayed a sign in a form similar to the form illustrated at the end of this Regulation must not pass the bus on a road or road related area at a speed of more than 40 kilometres per hour if the warning system of the bus (being the warning system referred to in Regulation 136A) is activated.
(2)
This Regulation does not apply in relation to a length of road or road related area in respect of which a speed limit has been fixed under section 4A (3) of the Act as indicated by a sign illustrated in Diagram 9 in the Schedule to Regulation 54A.
