His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Traffic Act 1909.

Explanatory note

The object of this Regulation is to extend the special parking concession scheme for disabled persons so that it covers persons with temporary mobility disabilities. The scheme at present covers persons who are unable to walk, or can only walk short distances, because of permanent loss of the use of one or both legs or because of some other permanent handicap. In order to more accurately reflect the scope of the parking concession scheme for persons with mobility disabilities, this Regulation also provides that the authority issued to disabled persons will be known as a “mobility parking scheme authority”.

This Regulation is made under the Traffic Act 1909, including section 3 (the general regulation making power).

1 Name of Regulation

This Regulation is the Motor and General Traffic Amendment
(Disabled Persons) Regulation 1996.

2     Amendment of Motor Traffic Regulations 1935

The Motor Traffic Regulations 1935 is amended as set out in
Schedule 1.

3     Amendment of General Traffic Regulations 1916

The General Traffic Regulations 1916 are amended as set out in

Schedule 2.

The explanatory note does not form part of this Regulation.

(Clause 2)

[ 1 ]       Regulation 2 Definitions

Omit the definition of Disabled person.
Insert instead:

Disabled person means a person:

(a) who is unable to walk because of permanent loss of the use of one or both legs or other permanent medical or physical condition, or
(b) whose physical condition is detrimentally affected as a result of walking 100 metres, or
(c) who requires the use of crutches, a walking frame, callipers, scooter, wheelchair or other similar mobility aid.

Omit the definition of Disabled person’s parking authority.
Insert instead in alphabetical order:

Mobility parking scheme authority means an authority issued by the Authority:

(a) to a disabled person, or
(b) to an organisation for the purpose of conveying a specified disabled person or persons.

[3]        Regulation 54 Traffic control signs

Omit “disabled person’s parking authority," wherever occurring from
Regulation 54 (4) (e), (6) (m1), (10), (11), (12), (13) and (14).
Insert instead “mobility parking scheme authority”.

[4]        Regulation 54

Insert after Regulation 54 (10):

(10A) A disabled person’s parking authority issued by the Authority and in force immediately before the Motor and General Traffic Amendment (Disabled Persons) Regulation 1996 took effect is taken to be a mobility parking scheme authority issued by the Authority under clause (10).

[5]        Regulations 91H, 91R, 91BB

Omit “disabled person’s parking authority” wherever occurring from
Regulations 91H (9) (b), 91R (8) (b) and 91BB (9) (b).
Insert instead “mobility parking scheme authority”.
Schedule 2 Amendment of General Traffic
Regulations 1916

Section 13A Traffic control signs

Omit “disabled person’s parking authority” wherever occurring from
section 13A (4) (e) (ii) and (6) (m1).
Insert instead “mobility parking scheme authority”.
