Queensland Trading (Allowable Hours) Amendment Act 1998 Act No. 45 of 1998 An Act to amend the Trading (Allowable Hours) Act 1990 [Assented to 27 November 1998]

s1 4 Trading (Allowable Hours) Amendment The Parliament of Queensland enacts— s3 No. 45, 1998 ˙ Short title 1. This Act may be cited as the Trading (Allowable Hours) Amendment Act 1998 . ˙ Act amended 2. This Act amends the Trading (Allowable Hours) Act 1990 . ˙ Insertion of new part 3. After section 48— insert— ‘ PART 9—PROVISIONS FOR BOXING DAY 1998 ˙ ‘ Definition for pt 9 ‘ 49. In this part— “trading hours order” means the order titled Trading Hours—Non- exempt Shops Trading by Retail—State made by the industrial commission on 27 November 1992 as varied by the industrial commission from time to time. ˙ ‘ Application ‘ 50. This part applies only to a non-exempt shop to which the trading hours order applies. ˙ ‘ Allowable hours Boxing Day Saturday 26 December 1998 ‘ 51.(1) This section applies despite section 28 and the trading hours

s3 5 s3 Trading (Allowable Hours) Amendment No. 45, 1998 order. 1 ‘ (2) On Saturday 26 December 1998, the occupier of a non-exempt shop, other than an excluded shop, must ensure the shop is closed. Maximum penalty—40 penalty units. ‘ (3) On Saturday 26 December 1998, the occupier of an excluded shop must ensure the shop is closed at all times other than the times at which it may be open under the trading hours order on a public holiday. Maximum penalty—40 penalty units. ‘ (4) However on Saturday 26 December 1998, the occupier of an excluded shop in the “area of the city heart” of the inner city of Brisbane, as defined in the trading hours order, must ensure the shop is closed at all times other than times at which it may be open under the trading hours order on Boxing Day. Maximum penalty—40 penalty units. ‘ (5) In this section— “excluded shop” means a non-exempt shop in the following areas as defined in the trading hours order— (a) “area of the city heart” of the inner city of Brisbane; (b) near north coast area; (c) sunshine coast area; (d) gold coast area; (e) tourist and/or seaside resorts; (f) Cairns tourist area. ˙ ‘ Allowable hours Monday 28 December 1998 ‘ 52.(1) This section applies despite section 28 and the trading hours order. ‘ (2) On Monday 28 December 1998, the occupier of a non-exempt shop must ensure the shop is closed at all times other than the times at which it 1 Section 28 (Occupier to comply with order relating to premises).
