Trade Practices (Telecommunications Exemptions) Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Trade Practices Act 1974.

Principal Regulations

1. In these Regulations, "Principal Regulations" means the Trade Practices (Telecommunications Exemptions) Regulations.

Exemption of conduct referred to in paragraph 4 (a)

2. Regulation 5 of the Principal Regulations is amended by omitting "1989" and substituting "1991".

Application of exemption

3. Regulation 11 of the Principal Regulations is amended by adding at the end the following subregulation:

"(2) Conduct specified in regulation 4 is exempt from the application of subsection 45 (2) of the Act only to the extent that such conduct by a prescribed authority would, but for the operation of regulations 5, 6, 7, 8, 9 and 10, be in contravention of subsection 47 (1) of the Act.".

Further amendments

4. The Principal Regulations are further amended as set out in the Schedule.

FURTHER AMENDMENTS OF THE PRINCIPAL REGULATIONS

Regulation 5:

Insert "subsection 45 (2) and" after "regulation 11,".

Regulation 6:

Insert "subsection 45 (2) and" after "regulation 11,".

Regulation 7:

Insert "subsection 45 (2) and" after "regulation 11,".

Regulation 8:

Insert "subsection 45 (2) and" after "regulation 11,".

Regulation 9:

Insert "subsection 45 (2) and" after "regulation 11,".

Regulation 10:

Insert "subsection 45 (2) and" after "regulation 11,".
