Trade Practices Regulations 2(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Trade Practices Act 1974.

1.   Commencement

1.1   These Regulations commence on 1 April 1992.

2.   Amendment

2.1   The Trade Practices Regulations are amended as set out in these Regulations.

3.   Regulation 38 (Application for provisional registration of conference agreement)

3.1   Subregulation 38 (1):

Add at the end:

“; and (c)

be accompanied by the prescribed fee.”.

4.   Regulation 40 (Application for final registration of a conference agreement)

4.1   Subregulation 40 (1):

Add at the end:

“; and (c)

be accompanied by the prescribed fee.”.

5.   Regulation 42 (Notice of the happening of an affecting event)

5.1   Subregulation 42 (2):

Add at the end:

• “; and (e)

  the effect of the event on the provision of outwards liner cargo shipping services.”.

6.   Regulation 44 (Application by ocean carrier for registration of agent)

6.1   Subregulation 44 (1):

Omit “and be accompanied by a copy of the instrument appointing the agent.”, substitute:

“and be accompanied by:

• (a)

  a copy of the instrument appointing the agent; and

(b)

the prescribed fee.”.

7.   Regulation 45 (Notice of change of agent etc.)

7.1   Subregulation 45 (1):

Omit the subregulation, substitute:

“(1)

A notice under subsection 10.72 (1) of the Act must be in accordance with Form 7 of Schedule 3 and be accompanied by:

(a)

a copy of the instrument appointing the agent; and

(b)

the prescribed fee.”.

8.   Regulation 47 (Verification of documents)

8.1   Subregulation 47 (1):

After “of the Act”, insert “or a notice under subregulation 45 (1)”.

8.2   New subregulation 47 (3):

After subregulation 47 (2), insert:

“(3)

In the case of a varying conference agreement lodged for registration in consolidated form, the person lodging it must declare that the parties to the agreement have agreed to the terms of the varying conference agreement in consolidated form.”.

9.   Schedule 2

9.1   Omit the Schedule, substitute:
