  1. Name of regulation

    This regulation is the Trade Measurement (Prepacked Articles) Amendment Regulation 2009 (No 1).

  2. Commencement

    This regulation commences on the day after its notification day.

    NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

  3. Legislation amended

    This regulation amends the Trade Measurement (Prepacked Articles) Regulation 1991.

  4. New section 11 (2) (ab)

    insert

    (ab)a standard wine package if the measurement marking on the package complies with section 11A; or

  5. New section 11A

    insert

11APosition of measurement marking on standard wine package

(1)For section 11 (2) (ab), the measurement marking on a standard wine package must be made on the surface of the package, other than the base or the top, in a way that allows all of the following information about the wine to be seen in a single field of vision:

(a)the statement of the measurement;

(b)the country of origin;

(c)the product name or product description;

(d)the actual alcohol content by volume in percentage terms.

(2)For subsection (1), information on a standard wine package can be seen in a single field of vision if a person can see the information without having to turn the package.

  1. Dictionary, new definitions

    insert

    standard wine package means a package containing—

    (a)50mL, 100mL, 187mL, 200mL, 250mL, 375mL, 500mL, 750mL, 1L or 1.5L of wine; or

    (b)2 or more whole litres of wine.

    wine means a beverage—

    (a)produced by the complete or partial alcoholic fermentation of fresh grapes, grape must or other products derived from fresh grapes; and

    (b)containing not less than 7% and not more than 24% of alcohol by volume.
