Trade Measurement (Pre-packed Articles) Amendment Regulations 2009

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Trade Measurement Act 1999 .26 June 2009

1Short titleThese regulations may be cited as the Trade Measurement (Pre-packed Articles) Amendment Regulations 2009 . 2CommencementThese regulations take effect on the day on which their making is notified in the Gazette. 3Principal RegulationsIn these regulations, the Trade Measurement (Pre-packed Articles) Regulations 2000 are referred to as the Principal Regulations. 4Regulation 2 amended (Interpretation) Regulation 2 of the Principal Regulations is amended as follows: (a) by omitting "article." from the definition of measurement marking and substituting "article;"; (b) by inserting the following definitions after the definition of measurement marking : standard wine package means a package containing – (a) 50 millilitres, 100 millilitres, 187 millilitres, 200 millilitres, 250 millilitres, 375 millilitres, 500 millilitres, 750 millilitres, one litre or 1.5 litres of wine; or (b) 2 or more whole litres of wine; wine means a beverage – (a) produced by the complete or partial alcoholic fermentation of fresh grapes, grape must or other products derived from fresh grapes; and (b) containing not less than 7% and not more than 24% of alcohol by volume. 5Regulation 11 amended (General position of measurement marking) Regulation 11(2) of the Principal Regulations is amended by omitting paragraph (b) and substituting the following paragraphs: (b) a standard wine package if the measurement marking on the package complies with regulation 11A ; or (c) any other package if – (i) the administering authority, by notice published in the Gazette, exempts the package from the operation of this regulation; and (ii) any conditions or restrictions specified in the notice are complied with. 6Regulation 11A insertedAfter regulation 11 of the Principal Regulations , the following regulation is inserted in Division 1: 11APosition of measurement marking on standard wine package (1)  For the purposes of regulation 11(2)(b) , the measurement marking on a standard wine package must be made on the surface of the package, other than the base or the top, in a way that enables all of the following information about the wine to be seen in a single field of vision: (a) the statement of the measurement; (b) the country of origin; (c) the product name or product description; (d) the actual alcohol content by volume in percentage terms. (2)  For the purposes of subregulation (1), information on a standard wine package can be seen in a single field of vision if a person can see the information without having to turn the package.
