Trade Marks Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Trade Marks Act 1955.

Commencement

1. These Regulations commence on 18 July 1990.

Principal Regulations

2. In these Regulations, "Principal Regulations" means the Trade Marks Regulations.

3. The Principal Regulations are amended by inserting after regulation 15 the following regulation:

Advertisement of the withdrawal of an application under section 40A of the Act

"15A. If an application for the registration of a trade mark is withdrawn under section 40A of the Act, the Registrar must, as soon as practicable, notify that fact in the Official Journal.".

The Schedules

4. The Schedules to the Principal Regulations are amended:

(a) by omitting the heading "THE SCHEDULES";

(b) by omitting from the heading to the First Schedule "FIRST SCHEDULE" and substituting "SCHEDULE 1";

(c) by omitting from the heading to the Third Schedule "THIRD SCHEDULE" and substituting "SCHEDULE 3";

(d) by omitting from the heading to the Fourth Schedule "FOURTH SCHEDULE" and substituting "SCHEDULE 4";

(e) by omitting from item 8 of Schedule 4 ", forks and spoons";

(f) by omitting from item 9 of Schedule 4 "and data processing equipment" and substituting ", data processing equipment and computers";

(g) by omitting from the heading to the Fifth Schedule "FIFTH SCHEDULE" and substituting "SCHEDULE 5".

Further amendments of the Principal Regulations

5. The Principal Regulations are further amended as set out in the Schedule.
