Trade Marks Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and under section 4 of the Acts Interpretation Act 1901, make the following Regulations under the Trade Marks Act 1955.

1.   Commencement

1.1   These Regulations commence on 29 June 1994.

2.   Amendment

2.1   The Trade Marks Regulations are amended as set out in these Regulations.

3.   New regulation 72A

3.1   After regulation 72, insert:

Delegation by Registrar under paragraph 11 (1) (a) of the Act

 “72A. In relation to the powers of the Registrar under the Act, other than the powers under paragraphs 119 (a) and (c) of the Act, a person referred to in Schedule 7, being a person holding or performing the duties of an Australian Public Service Office in the Trade Marks Office, is a prescribed person for the purposes of paragraph 11 (1) (a) of the Act.”.

4.    Schedule 4A (Convention countries for the purposes of the Act)

4.1   After “Bolivia”, insert “Bosnia and Herzegovina”.

4.2   After “Egypt”, insert “El Salvador”.

4.3   After “Gambia”, insert “Georgia”.

4.4   After “Holy See”, insert “Honduras”.

4.5   After “Korea, Republic of”, insert “Kyrgyzstan”.

4.6   After “Liechtenstein”, insert “Lithuania”.

4.7   After “Norway”, insert “Paraguay”.

4.8   After “Syrian Arab Republic”, insert:

“Taiwan

“Tajikistan

“The former Yugoslav Republic of Macedonia”.

5.    New Schedule 7

5.1   Add at the end of the Regulations:

 SCHEDULE 7 Regulation 72A

PRESCRIBED PERSONS—PARAGRAPH 11 (1) (a)

OF THE ACT

A person holding or performing the duties of a Senior Officer, Grade A, in the Trade Marks Office

A person holding or performing the duties of a Senior Officer, Grade B, in the Trade Marks Office

A person holding or performing the duties of a Senior Officer, Grade C, in the Trade Marks Office

A person holding or performing the duties of a Senior Officer, Grade C, Examiner of Trade Marks, in the Trade Marks Office

A person holding or performing the duties of an Administrative Service Officer, Class 6, Examiner of Trade Marks, in the Trade Marks Office

A person holding or performing the duties of an Administrative Service Officer, Class 5, Examiner of Trade Marks, in the Trade Marks Office

A person holding or performing the duties of an Administrative Service Officer, Class 4, Examiner of Trade Marks, in the Trade Marks Office

A person holding or performing the duties of an Administrative Service Officer, Class 3, Examiner of Trade Marks, in the Trade Marks Office

A person holding or performing the duties of an Administrative Service Officer, Class 6, in the Trade Marks Office

A person holding or performing the duties of an Administrative Service Officer, Class 5, in the Trade Marks Office

A person holding or performing the duties of an Administrative Service Officer, Class 4, in the Trade Marks Office

A person holding or performing the duties of an Administrative Service Officer, Class 3, in the Trade Marks Office
