Trade Marks Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Trade Marks Act 1955.

1.    Commencement

1.1   These Regulations commence on 1 October 1994.

2.   Amendment

2.1   The Trade Marks Regulations are amended as set out in these Regulations.

3.   Regulation 4 (Fees)

3.1   Subregulation 4 (3):

Omit “Item 4”, substitute “Item 3”.

4.   New regulations 7A and 7B

4.1   After regulation 7, insert:

Request for expedited examination

“7A.

(1) A person who applies, or has applied, for the registration of a trade mark may request the Registrar to expedite the examination of the application under section 41 of the Act.

“(2)

A request must:

  • (a)

    be made in writing; and

  • (b)

    state the reasons for making the request.

“(3)

Where a request is duly made, the Registrar must decide whether to grant or refuse the request.

Expedited examination—powers of Registrar

“7B.

(1) The Registrar must, as far as practicable, consider applications for the registration of a trade mark in respect of which requests under regulation 7A have been granted:

  • (a)

    before he or she considers applications for registration in respect of which no requests for expedited examination have been granted; and

  • (b)

    in the order in which requests in respect of the applications were lodged.

“(2)

The Registrar may expedite examination of an application for registration in the absence of a request if expedited examination is warranted in all the circumstances.

“(3)

For the purposes of subregulation (2), the relationship of the application for registration to any other application for registration is a relevant circumstance.”.

5.   Schedule 2 (Fees)

5.1   Item 1:

Omit “$50” (twice occurring), substitute “$65”.

5.2   Item 4:

Omit “$60” (first occurring), substitute “$65”.

5.3   Item 4:

Omit “$60, plus $30”, substitute “$65, plus $35”.

5.4   Item 5:

Omit “$100”, substitute “$250.”

5.5   Item 6:

Omit “$75”, substitute “$100”.

5.6   Item 11:

Omit “$55”, substitute “$65”.

5.7   Item 13:

Omit “$55”, substitute “$65”.

5.8   Item 14:

Omit “$50”, substitute “$65”.

5.9   Schedule 2 is further amended in accordance with the following table:
