D T E H S E CRI T P R T A IO D N E S (TEXTILE PRODUCTS) ACT [ASSENTED TO 9TH DECEMBER, 1947.] AMEND~1E?"T ACT OF 1947, -B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows;- I. This Act may be cited as "The Trade Short title Descriptions (Textile Products) Act Amendment Act ojand . 1947," and shall be read as one with *" The Trade constructIOn. Descriptions (Textile Products) Act of 1944," herein referred to as the Principal Act. The Principal Act and this Act may collectively Collective be cited as " 'Phe Trade Descriptions (Textile Products) title. Section two of the Principal Act is amended by Amendment inserting, after the definition of the term "False trade of s. 2. description" therein, the following definition, namely;- " " Fibre "-Means wool, hair, silk, cotton, fibre Fibre. of flax, or any other fibre, natural or artificial. The following section, numbered 5A, is inserted inserted. after section five of the Principal Act, namely:- Grounds for " [5A.] In proceedings for an offence against section defence. three of this Act in respect of any textile products it shall be a defence- (a) In a case where the defendant is the manu- factUrer of the products, that the percentages of the fibre contents of the products did not differ from those stated in the description by more than three per centum in the aggregate; (b) In a case where the products are imported goods, that the products were sold having applied thereto a description showing all particulars required by or pursuant to the *Oommerce (Trade Descriptions) Act, 1905- 1933, of the Commonwealth, and the regulations thereunder; (c) In any case, that at the time when the offence occurred the products bore the same descrip· tion as had been applied to them when the defendant acquired them and that that description appeared to comply with this Act and had not been altered in any way by the defendant." * No. 16 of 1905 and amending Acts.
