B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows : - 1 This Act may be cited as "The Trade Coupons Short title. Act of 1912." 2. In this Act, unless the context otherwise indi- Interpreta- cates, the following terms have the meanings respectively tion. assigned to them, that is to say,- "Goods" include trade coupons or any tickets, checks, tokens, documents, or orders directly or indirectly authorising or entitling any person to travel by any. railway, tramway, boat, or conveyance, or to obtain meals or refreshment, or to play or take part in any indoor or out- door game or sport, or to be admitted into any theatre, concert hall, racecourse, cricket or football ground, circus or place of public amusement or entertainment, or to obtain or receive any valuable consideration or benefit or advantage of any kind whatsoever; "Sale" includes th~ exchange or other disposition of any property; "Trader"-Any person, firm, or company carrying on any business; "Trade coupon"-Any stamp, coupon, cover or portion of cover, package, paper, document, means, or device supplied by any trading stamp company or issued ·by any trader with

No. 14, Trade : ~ ~ h~ ~ : d. or in connection with the sale of or adver- tising of any goods, or any advertisement of any trader relating to the sale or the offer for sale of any goods, which entitles the holder thereof or person producing the same to demand and receive from any trading stamp company., or from any person, firm, or company other than the said trader, any money or goods, or which entitles the holder thereof or person producing the same or any number or com- bination of the same, to demand and receive from the said trader any goods free of cost or at any reduced or alleged reduced price; " Trading stamp company"-Any person, firm, or company who supplies any trade coupon to any trader, and undertakes to redeem the same or that the same will be redeemed by giving or delivering to the holder thereof or person producing the same any money or goods. 3. (1.) No person shall, on the sale of or in con- nection with the sale or free distribution of any goods- (a) Issue or deliver with or about such goods any trade coupon to any person; (b) Deliver goods containing or having affixed or attached thereto or accompanied by any promise or offer that the purchaser or any other person shall be entitled to any refund, gift, allowance, reward, valuable consideration, benefit, or auvantage of any kind whatsoever dependent on the purchase of goods or of any quantity thereof, or entitling the purchaser or any other person to participate in any competition for any refund, gift, allowance, reward, valuable consideration, benefit, or advantage of any kind whatsoever. (2.) No person shall advertise III any newspaper, leaflet, handbill, or other printed or written matter any trade coupon. (3.) Provided that nothing herein shall debar any seller of goods from issuing therewith or in connection therewith a statement that, in the event of insufficient or defective quality, a total or partial refund of the purchase money. may be allowed.
MERCANTILE. 5669 1912. Trade Coupons Act. (4.) No person shall give or deliver any money or goods on presentation or production of any trade coupon. (5.) Any person who contravenes this section shall be liable to a penalty not exceeding ten pounds. (6.) For the purposes of this section; the person on whose behalf any sale or free distribution of goods is made by an a~ent, assistant, or apprentice shall be deemed to be the person who effected the sale or distribution; and such agent, assistant, or apprentice shall also be liable to the same penalty as the, person on whose behalf the sale or distribution was made. 4. With respect to any trade coupons issued before Trade the passing of this Act, the following provision shall fs~ ~ ~ ~ ns apply :- prior to Act. If the trade coupons issued by any trader ts any person have been supplied to such trader by any trading stamp company, then such company-or if such coupons have been issued or advertised by the trader undertaking himself to redeem the same or that the same will be redeemed by giving or delivering to the holder thereof or person producing the same any money or goods, then such trader-shall be liable to give or deliver to the holder thereof or person producing the same cash to the value of twenty ,shillings in the pound relatively to the cash value of COupons presented or produced, or goods to an equal value at the option of the trading stamp company or trader, as the case may be. , . If the trading stamp company or trader, as the case may be, fails to observe and perform the liability imposed on it or him by this section, the person presenting or pro- ducing such coupons may recover from such company or trader the full amount of the nominal or face value of such coupons on complaint in a summary way, or by action in any court of competent jurisdiction. 5.
