This instrument is the
Trade and Customs Legislation Amendment (Miscellaneous Measures) Regulations 2018 .
(1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under the following:
(a) the
Commerce (Trade Descriptions) Act 1905 ;(b) the
Customs Act 1901 .
Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.
Repeal the section, substitute:
(1) A person must not import goods if:
(a) the goods are covered by Subdivision B; and
(b) the goods are not covered by Subdivision C.
(2) Subsection (1) does not apply if a trade description is applied to the goods in accordance with Division 2.
Note: Section 7 of the Act:
(a) provides the basis for this section; and
(b) provides for the forfeiture of goods imported in contravention of this section.
A person commits an offence of strict liability if the person contravenes section 8.
Note: A defendant bears an evidential burden in relation to the matter in subsection 8(2) (see subsection 13.3(3) of the
Criminal Code ).Penalty: 50 penalty units.
