The issue said to warrant the grant of special leave to appeal in this case turns on the construction of the particular terms of a bespoke agreement. In this regard, no issue of principle of general importance arises. In addition, the decision of the Court of Appeal of the Supreme Court of Victoria is not attended with sufficient doubt to warrant the grant of special leave to appeal. The application for special leave to appeal should be refused.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application and providing that the applicant pay the costs of the second respondent.
