CaseChat Overview and Summary
The legal issue before the Commission was whether the proposed agreement met the requirements of the Fair Work Act for it to be approved. The Commission noted that the applicant had certified the agreement as a "bargaining agreement" and that it had been registered by the Fair Work Ombudsman. The Commission also noted that it had previously certified the agreement as a "single interest employer agreement" and that the applicant had not appealed that decision. The Commission held that the proposed agreement met the requirements of the Fair Work Act and approved the agreement.
The Fair Work Commission approved the Tox Free Australia Pty Ltd – Mid-West Region Enterprise Agreement 2015-2018 as a registered agreement. The Commission ordered that the agreement be registered in accordance with section 233 of the Fair Work Act. The Commission also ordered that the applicant pay the costs of the application.
