449 wluzmfan^ ANNO VICESIMO QUINTO ELIZABETHAE SECUNDAE REGINAE No. 45 of 1976 An Act to amend the Townsville City Council (Sale of Land)Act 1973 in a certain particular [ ASSENTED TO 5TH MAY, 1976] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Townsville City Council (Sale of Land) Act Amendment Act 1976. (2) The Townsville City Council (Sale of Land) Act 1973 as amended by this Act may be cited as the Townsville City Council (Sale of Land)Act1973-1976. 2. Amendment of s. 6. Section 6 of the TownsvilleCityCouncil(Sale of Land) Act1973 is amended by inserting after subsection (3) the following subsection:- (4) Notwithstanding any other provision of this Act and to remove any doubt as to the validity of certain agreements to sell allotments of the scheduled land entered into by the Council with purchasers prior to the commencement of the Townsville City Council (Sale of Land) Act Amendment Act 1976 containing
450 Townsville City Council (Sale of Land) Act Amdt Act 1976, No. 45 terms and conditions at variance with the terms and conditions imposed by the Governor in Council with respect thereto pursuant to this Act, it is hereby declared that the Governor in Council may, in respect of any such agreement to sell, vary the terms and conditions previously imposed by him so that they correspond to the terms and conditions in question contained in the agreement upon being satisfied that the agreement was entered into by the Council in good faith for the purpose of giving effect to the objects and purposes of this Act; and where the Governor in Council so varies the terms and conditions as aforesaid, the agreement is and is deemed always to have been a valid and effectual agreement to sell, so far as compliance with this section and section 7 is concerned, as if the terms and conditions as so varied had been the terms and conditions imposed by the Governor in Council in the first instance.".
