[ASSENTED TO 5TH NOVEMBER, 1925.] B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title. 1. This Act may be cited as "The Townsville Bridges Act of 1925." Authority to 2. The Council of the City of Townsville is hereby manadintain authorised and empowered- construct, (a) To alter and thereafter permanently to main- & & cc. . , , obvreidr ges, tain a bridge over Ross Creek, within the Ross Creek. said City, conn.ecting Stokes and Palmer streets, roads within the said City, and known as Victoria Bridge (the site of which bridge Schedule. is shown on the map in the Schedule hereto), without making provision for the opening of a portion thereof to· allow the passage of vessels, or to construct·a new bridge at the said site, and thereafter permanently to maintain, renew, modify, extend, or enlarge the same without making provision for the opening of a portion thereof to allow the passage of vessels; and (b) To construct and thereafter permanently to maintain, renew, modify, extend, or enlarge a bridge over Ross Creek within the said City at the point where btanley Street, a road within the said City, abuts on Ross Creek (the site of which bridge is shown on the map in the Schedule hereto) without

Townsville Bridges Act. making provision for the opening a portion thereof to allow the passage of vessels; and also (c) To construct, and thereafter permanently to maintain, renew, modify, extend, or enlarge, over or adjacent to Ross Creek, at or near a point shown on the map in the said Schedule, a causeway or bridge or a combined causeway and bridge as part of and an extension of Queen's Road, a road within the said City. 3. No action, indictment, information, or other No action proceeding shall be commenced, presented, prosecuted, to lie. or maintained against the Council of the City of Towns- ville or any contractor with it or any of its or his agents, officers, or workmen for or in respect of the alteration and maintenance of the said Victoria Bridge or the construction, maintenance, renewal, modification, exten- sion, or'enlargement of a new bridge at the same site, or the construction, maintenance, renewal" modification, extension, or enlargement of a bridge over Ross Creek at the po':nt where Stanley Street abuts thereon without in any case making provision for the opening of a portion thereof to allow of the passage of vessels, or the. construction, maintenance, renewal, modification, extension, or enlargement of the causeway or bridge or combined causeway and bridge aforesaid, or any alleged obBtruction of the navigation of the Ross River or Ross Creek, or deprivation of access to the said river or creek, or for or in respect of any damages, loss, or expenses whatsoever occasioned or alleged to be occasioned by reason of such alteration, construction, maintenance, renewal, modification, extension, enlargement, obstruc- tion, or deprivation, or in anywise whatsoever arising therefrom: Provided that nothing in this Act shall be construed to affect the immunities or duties, liabilities, or obliga- tions of the Council as a Local Authority with respect to the said bridges or any of them, or the said causeway, or combined causeway and bridge as roads respectively under *"The Local Authori#es Acts, 1902 to 1924," whether during alteration or construction of the same or at any time thereafter. * 2 Edw.
